H4/Dependent Visa

I am not so familiar with immigration process. This question could just be a basic one for the pros. My company's lawyer has filed for my 140/485 concurrently, got EAD and Advanced parole, I have used EAD for a year now.

1. Can I still get a H4 for my spouse? If yes how I go about doing it?

2. If I cannot get H4 for my spouse, are there any alternatives?

All the responses are welcome,

Thanks,

1. Afaik, the answer is 'No'. You can only get an H4 for your spouse if you are currently on a valid H1 status. Since you have been using your EAD for a year or so, a H4 for your spouse is not possible.

2. Assuming your spouse is not in the US currently, I'm not sure what the answer is. Wild guess: Your spouse may have to file for CP as he/she is outside the country.

I'm not a lawyer, so please check with your immi lawyer before making any decision/taking any steps.
