I am currently in U.S on H4 dependent visa expiring on Nov 26, 09. My husband's company 'A' has also filed for his another 3 year H1-B extension which is currently under processing stage with USCIS. I have also applied for my NEW H1-B from another company 'B'.
My question is:
#1) Given that my H4 dependent visa is expiring on 26-Nov-09 and if my H1-B petition is also approved from company 'B', Can I go to India this year in Oct, 09 and return back in Dec, 09 on my H4 dependent visa in which case I will require to go to U.S. consulate to extend my H4 dependent visa ?
#2) Do I have an option to continue to be on H4 dependent visa even though I will have an approved H1-B visa from Oct 01, 09 ?
#3) Is it possible to put my H1-B visa from company 'B' on suspension or freeze status even though it gets approved from Oct 1, 09 so that I can continue to keep myself on H4 dependent visa status which is my primary preference ?
