H4 - applying for ITIN

Hi everyone,

I'm on H1B and my wife is on H4. I will be filing a joint return with my wife for the first time this year. I have filled out the W7 form to apply for her ITIN. However, I'm in a bit of a confusion regarding her name. Her passport and visa are in her maiden name. But on the marriage certificate, we had the last name changed to mine. Now, in 1a of the W7, should I be putting her married name or her maiden name? If I put down her married name in 1a, surely I'll be writing down her maiden name in line 1b. But in that case, I would also need to submit my marriage certificate as proof of her name change, right? And for that, would I need an affidavit from some place here to verify that both names refer to the same person and get this notarized?
Sorry - I'm just not sure what I need to be doing here. I would appreciate any help or pointers.

May be this will help you

There are a couple of things I think you can do .

First of all get a new passport for your wife from one of the indian consulates here in US. I am not sure which consulate will serve you but you can visit http://www.indianembassy.org/consular/instructions.htm for more information. It takes about 3 weeks to get this processed.

However, you might not have that much time to get a new passport so I would suggest that you get a copy of the your wife's passport notarized and get a notarized affidavit stating that the name of your wife was changed after marriage. You can get a copy of such affidavit from

Just after I posted my message, this is what I thought of:
I'll simply keep using my wife's maiden name wherever required till I get my passport changed. For the ITIN, what they need is simply verification of the name, age, etc thats on the W7 which would be exactly as per my wife's passport. Do you think that would work? your thoughts?

Yeah most definitely.... this will work.... coz if her name on the passport is still her maiden name then why get into the hassle ....

This will sure keep it simple .... :cool:
