H4 and I94 Question, need suggestion........

Hi Friends,
Please reply to this, my wife had a valid H4 status till March 28, 2004 and we have applied for extension (I-539) for her H4 on March 15, 2004.
But she left to India, before the approval notice came, i.e May 12, 2004. So she had old expired date on I-94. Will be entered in system that, she had over stayed in US. Will this impact the Green card processing(I-140,485 on Jan 1st, 2004).
Will this cause a problem, when she tries to come back to US on H4 again.

How can we be prepared with answers?

She will be in valid status upto 90 days or may be more after she files for the H4 extension. So she is not out of status and thus will not impact your GC. Now you can send the H4 approval notice and get her stamping in India or you can use your AP if you have one.
