I am in H1B, my passport have a visa until April 2005. I changed the employer, my new employer filed a H1 and this is valid until 2004 August.

I send my passport to get new stamp, but they returned the passport saying that I have a valid visa.

I am getting married in May. Will there be any problem to get a dependent visa.

Thanks
Jijo.

{I am assuming that above is an error. Is your new H1 valid
till 2005 August? }

{Obviously! The Center at St.Louis will accept visa re-validation
cases as following:

a) Only within 60 days prior to the expiry of the present visa

OR

b) Only within 1 year from the date of expiry of the present
visa.}

{This would not hamper her/his chances }

<No the above is right. I have visa until August 2004. (I do have EAD and my I485 is filed I140 is approved)

The concern that I have is if I send my passport to get a dependent visa will there be any problem because the current employer's visa is not in my passport.

Thanks

jijo,

That should not be a problem. What you would do is send a copy of your new H1 approval along with a copy of your passport (all pages) with your spouse.
