I have an H1B petition after COS from L2.
My employer has not paid me since Oct1,2008 and is threatening to cancel my H1 B effective from Oct 1.
To get back on L2 I am planning to go to india and come back.(I have L2 visa stamped)
1. Would being out of status on H1B result in issues during extension/port of entry for L2 ?
3. My employer has refused to give me new I-94 from my H1B. If the new I-94 is not returned, would this be a problem in future, during extension/port of entry for L2 ?
