H1B vs I 485

I am a bit concerned. My 485 has been pending for 19 months (California). My H1B (three years) completed on 22nd of October, 2003 however, I did not apply for extension. My lawyer said I can continue to work on EAD.

I just handed my EAD copy to my HR (prior to completion of my H1B1). Do I need to to do anything else? I mean what else I need to do.....Plz comment..


Secondly did I make a mistake by not extending my H1B1 for another three years.? Plz comment.....

Since I have started using my EAD (for almost one week now) can I apply for the H1B1 extension for my remaining three years? Folks plz help me.

Yes! You need to fill out a new I-9 form.

Probably! But too late to cry over spilt milk. Not that you lost that much, just the opportunity to work without waiting at 5:30 am for iEAD and getting your spouse over on H4 if you h aven't already!

How can you apply for an extension if your H1B has expired? All you can do is apply for a new H1, but that may not be worth the effort. Hopefully you should get your AOS soon!

I was on both sides of the fence on this one.

If you are on H, it is advisable to apply for EAD just in case, but there isn't much advantage the other way around. My lawyer says he is receiving approvals in the Aug 01 - Feb 02 time frame and that these cases should be over by April (this could be horseshit, but it is lawyer horseshit). So forget about EAD/H1/H4 etc etc and get on with your life.
