My H1B expires (first 3 year term) on October 31st 2006. I have visa till October 31st 2006. I am planning to travel outside the country in April 06 and May 06. I will be returning back to US in last week of May 2006.

Will there be any problem at the port of entry because of the reason that my H1B will be expiring in 5 months (June through October). Or will I have to apply for the extension before I go out of the country? How many days or weeks before the expiry of H1 can one come to US.

There should not be any problems whatsoever when you re-eneter. I once travelled back when my visa was 2 months away from expiry and at Port of Entry I was only asked if I my employer had already applied for an extension, to which I answered yes and was good to go. If you are very concerned, have an employer letter stating that you are going on vacation and will be back and continue your old job.
