I have one question. Let me give the background for the question.
I was employed with company A where I got H1B stamping for first term (3 years) of visa. Due to urgent family reasons, I needed to leave country (US) and resign from job. I left the country (surrendered my I94). I did not use complete 3 years of visa and left one year before it expired. Now the 3 year term has expired (it expired in April 2005).
I am now planning to come back to US and have also got an offer with Company B. My new company is exploring if I can get H1B through the remaining visa quota. However, I wanted to find if my case can be considered as H1B visa transfer since I did not use my prior visa completely. Or it is required to get a fresh visa for me?
