A friend of mine went for H1B visa stamp to a consulate in Mexico (Texas Border). He went with an approved H1B petition till August,09. Visa stamp was not put in his passport due to administrative process (a green slip with 221 g code). He was asked to come back to the consulate next day. He got a parole to enter US and he was told if he gets a call from consulate within 30 days, he may come back to the same consulate for visa stamp or else he would need to go to his home country for visa stamp.
He has already got his I-140 approved and waiting for priority date for I-485.
The questions are as follows:
1. What are the chances that he will get a call from consulate ?
2. Can he apply for new H1B through the same employer who sponspored current H1 and what would be the approval period (1 year or 3 years).
3. Given the above conditions, which GC process is better (Consular or within US).
