Details of my case in brief. My old H1B visa got expired on Nov.11, 2003. Along with it my I94 got expired too. I got my H1 B visa renewed(same employer)in advance, before the old one expired and is active. I plan to go to India in Feb.04. For this, I have scheduled a interview date for stamping my current H1B,(to get Multiple Entry) in Toronto on Dec. 16, 2003. Given the changes in the rules and regulations I have a few questions..
A)Is it a safe assumption/risk to take if all my papers are in order, that in Toronto they will issue me a Multiple entry stamping so that I can come back to US??
B) I have my papers in order, and if I get a Multiple Entry Stamped in Toronto, is it going to be a problem while re-entering US in Detroit, as my I94 tagged to the old H1B has expired? (I do understand that my new H1B approval has an I94 that is valid my current H1B expires in 2006. Can I use the new I94 that has come with my new H1B approval?)
C) Even if my papers are in order, in case (worst case scenario) I cant get the multiple entry done, is it true that I have to go to India from Toronto and get it stamped in a US consulate and then come back (since I cant re enter US even on a valid I94, let alone an expired one).
D) Also, what is the gaurantee that in Toronto/India they are going to approve( even though I have all my papers in order)?
