Hello there,

I am an H1b visa holder, I am currently on status (until Feb 2007) and I am applying for a GC based on marriage, I filed my paperwork on July 10 and had my interview on Sep 27th. The interview seemed to go well and the USCIS officer just told us that we should be receiving a letter with the decision. The USCIS officer kept my I-94 that day, and I forgot to ask her if I could travel out of the country without the I-94. I have traveled outside the country while the case is pending (I went to the bahamas for our delayed honeymoon), but I still had my I-94 at that time.

Would it be a problem if I travel without the I-94?

Thanks for your help.

Was your case approved,or is it Pending Name Check?
I believe you need to apply for an advance parole I 131 to travel abroad while your I 485 is still pending.
If you do not have it,and its an urgent need to travel abroad you can apply at your DO for an advance parole and try to get it on urgent bases.

I don't know if it is approved or is it pending name check (the officer did not said anything about the name check), but I understood that if you have an H1B visa you can still travel with it and you don't need AP. Does that change after the interview?

Yeah.If you have a 'stamped' visa you can surely come back on your H1.But again,if your case is approved you are a permanent resident and your H1 becomes null and void.

This is wat I believe, someone can confirm this.
