H1B Visa extension - employer will not give w2!!! HELP!!!

Hi...I went to see a lawyer to renew the H1B visa and he said I will need a w2 from my previous employer. The only problem is that the employer will not give a w2.

I was working for this employer for over 2 years - not being paid. But I invested over $500,000 of my money into the business too.

Can anyone advise me how to go about getting a w2 or what I would need to do legally in order to get the employer to give me a w2. I am thinking that the employer does not want to do this because they are not reporting all of the money they are making and avoiding paying the taxes.

Is there any way I can get the w2 and possibly get my money back from the employer and maybe transfer to another employer for my next 3 years after renewal? I am very concerned this will not work out and I don't want to go back to my homeland right now.

Please...any advice will help.
 
I'm not sure why you need W2 for H1 extension! Your company should just attach a letter to renewal application requesting renewal/extension if the extension is with the same employer.

If you are applying for extension through a different employer, then it is transfer + extension. In that case, you need recent paystubs! How come you didn't get paid? As a H1B, you are supposed to be paid.

The best thing you can do now is to extend/renew H1B with your current employer and start getting paystubs as soon you can. Once you get the approval, use the paystubs (at least 3) to transfer to another employer.

You invested $500,000 of your own money! Man, you should be rich! With that money, you could have got GC through Investor category.

Thank you for response...I mistyped...I only invested $300,000, the rest was from other investor.

Won't it make it harder for me to get renewal without paystubs for HB1? I know they are trying to keep all my money - but I don't know what to do to get it back. And I wont get paystubs because I think they are lying on their taxes cuz it is a high cash business.
