Hi...I went to see a lawyer to renew the H1B visa and he said I will need a w2 from my previous employer. The only problem is that the employer will not give a w2.
I was working for this employer for over 2 years - not being paid. But I invested over $500,000 of my money into the business too.
Can anyone advise me how to go about getting a w2 or what I would need to do legally in order to get the employer to give me a w2. I am thinking that the employer does not want to do this because they are not reporting all of the money they are making and avoiding paying the taxes.
Is there any way I can get the w2 and possibly get my money back from the employer and maybe transfer to another employer for my next 3 years after renewal? I am very concerned this will not work out and I don't want to go back to my homeland right now.
Please...any advice will help.
