I am on I-485 since one year and working on EAD. Expecting GC in the next 8 to 9 months (Nebraska) if things are moving at this pace.

I am just wondering what would be the status of guys who are on I-485 already (started using EAD, instead of being on H1) and who are on H1 already if this bill to eliminate the H1 program gets passed ? I mean, was the bill meant to stop just new H1 approvals or is it going to effect current H1 holders and I-485 guys who are technically not on H1 but not GC holders either.

I tried to pose this question to my lawyer and he responds in detail but he does not clarify the main concern about I-485 status guys.

At this time it looks as though the bill has no chances of getting passed but due to extensive lobbying by labor unions and anti-immigration groups. there is a chance that more and more congressmen will find it tempting to support it due to the natioanl mood and impending elections in 18 months. I don't know if this bill is a way of forcing the government to atleast reduce the H1 quota below 65000 in Nov 2003 when it comes for review.

I would appreciate if participants check with lawyers and give their input.
 
Lawyer's analysis

One of the lawyer has done this analysis about H1 elimination bill:

He thinks H1 elimination is not that simple. H1 holders comes from many countries and all of them will retaliate by closing their economies and cancelling contracts with US government.

He says that elimination of H1 program will also effect university enrollment and research. Many of the students who come from India and China come to USA as students in the hope of moving to H1 and then to GC. If H1 is stopped, no student from these countries will even bother to go through the horrible process of paying dollars for fee, go through security checks etc. just to get US degrees and go back to their countries for the same jobs which they are eligible to apply for anyway, without US degree certificates. Then not only multinational corporations but even universities will be upset. These two are the main engines of American economy and superiority.

He says, H1 holders contribute lots of social security and most of them go back to their countries without ever claiming benefits. That's nothing but free goodies to US govenrment.

He says, housing, automobile, travel and retailing industries will loose lots of potential customers.

He says he wouldn't be surprised if Bill Gates, CEO's of Oracle, IBM, PeopleSoft etc.. will just close shop here and apply for Indian citizenship.


Finally he says, the outrage against H1 is not really about loosing jobs but it has more to do with politically motivated feelings among conservative groups about immigration in general.
