Hi,
I filed H1B visa for my brother who is india. We were happy when his employer told that his application was picked. We came to know last week that his visa has been denied and denail notice has been sent. His employer said that its mere bad luck that he got struck in back ground check. We paid him 1500$ initially;Can we expect part if it back?
 
Paying a prospective employer for immigration benefit (such as H-1B for example) where you are not the actual petitioner is unlawful. Please note that you are just a beneficiary in H-1B cases (you were offered employment by the employer).

If it comes to the attention of USCIS, it is going to be treated extremely seriously.
 
There are some fees that can be paid by H1B visa applicant. These are listed on the USCIS website. These are not returned if the petition is denied only if the petition is not selected in the lottery.
