My wife has appoved H1B petition from company A with start date Jan 2006. It was filed when she was not in US, so she has to go to Mumbai consulate to get her I94. She recently came to US on H4-dependent visa.
There is an offer from company B which wants to process her H1B. Can company B apply for H1B transfer from A to B and since she is now in US, also request a COS? The cap will not be an issue because she was already counted for FY06 when approved for company A.
