I am currently working in Company A on a L1 visa. But I got a H1B visa done from one of the consultant company (Company B) that I know. Now there is another company different than the company that sponsored my H1 , which is ready to give me an offer. But they are telling me that they will have to do a new H1 visa for me.
I was under the impression that since I have a H1 already, its just a matter of transferring it.
But the company C is kind of hesitating to do the transfer.They want to do a new H1 for me, which means that they can only process the H1 in April and I can only start working from next October.
The problem is iam on an L1 right now and I cannot wait too long in this visa since I might be asked to go back to India. So I need to switch to the H1 as soon as I can,so that I dont need to go back.
My questions are:
1. Is it possible for me to transfer the H1 without running into any legal implications, even though I have not officially started working on the H1 from company B.
2. If not, if the new company is going to do a new H1, is there any way that I can get the visa soon and start working soon in the new company?
3. Is there any other way for me to start working in Company C at the earliest?
