I am currently working for a Company A. I have about 13 months before my 6 years H1B validation expires. My Green Card Labor petetion from Company A has been pending approval for more than 2 and half years. I am not sure if it is going to get approved because of number of layoffs that took place in A for the last 3 years. As such I would like to start my Green Card through another company B. I don't want to leave A immediately. My questions are specific to getting 7th year H1 B extension:
1. Does one need to have H1 with company like B for more than a year in addition to their labor pending approval from DOL over a period of one year to be eligible for 7th year H1 extension? Do you recommend to apply for a H1 transfer to B right now or can I defer it to a point when I decide to join B?
2.Can I continue to work for company A even if my transfer to B gets approved?
