H1b Transfer with Pay stubs ( 30 day gap)

Hi,

I got laid off on August 25 and got my last full pay stub on August 25 (for period ending August 21st) and a partial pay stub Sep 8th (Pay between august 21st and August 25th). I got a job on Sep 16th and my lawyer applied for H1b Transfer on 25th (it reached USCIS on 26th).

Can you please let me know how old the pay stubs can be for H1b Transfer? Mine is about 3 weeks old.

I applied H1B transfer at NSC.

H1 transfer without pay stub

Hi , The worst case scenario is that you may get an RFE asking for the latest pay stub and if you are not able to provide the latest ( 2 weeks old will be good enough ) , they will still approve your H1 transfer but deny your extension . This means that you will get your approval notice with no 1-94 attached below . You will have to leave the country immediately , go to you home country and get your visa stamping done . But if you are really lucky, the INS may even approve your extension without the latest pay stub .( in NSC , there is very less chance for this )
