H1B Transfer While Near End of H1 Third Year (Need Extension Soon!)

Currenlty, June 2008, I am on 3rd year of H1B (expires December 2008). I was told by my current employer that soon we need to file for extension since it takes 4+ months for the extension to be approved.

Here is the problem. I am looking for jobs with other companies at the moment and have some very good options for hiring. My worry is that I don't won't to jeoperdize my status. I am aware that once my current employer files for an extension I cannot transfer my H1B to a new company.

So my questions are:

  • If I get a new job offer from another company, can this new company transfer + extend my H1B visa? How is this exactly done?
  • Will the new hiring company be reluctant to hire me because they have to do both tranfer + extension or is this pretty common?
  • Would it be safer for me to first extend my H1 with the current employer and than look for a new company?

Please any feedback would really help

You needn't worry, the new empolyer can extend your H-1 visa. Transfer or Extension, all new applications are treated new.

manwithnoname, I was reading somewhere online that if I tranfer the H1 to company B from A, it will be valid until (in my case) December 2008 (which is when my current three-year expires). Then will the new employer need to file for an extension? How exactly is this done, first transfer and then extension? Any details would be appreciated!

Your new company can ask for extension at the time of applying for your H1 "transfer".

Thanks for your answers so far.

I am still a bit confused about this so any additional answers, perhaphs more detailed and clear, are welcome!
