H1B transfer when waiting to apply for I-485

Hi -

I'm on yearly H1B extension (11th yr) based on GC process. My labor & I-140 got approved and waiting to file I485 (with priority date June 2002 EB3-I).

My questions are:

1) Can I switch employer porting the priority date from current employer using approved LC & I140 (I hope curent employer may say OK to approved I-140 & LC) when I'm waiting to file I-485? (Reason for changing employer: Possible job-cut.)

2) Or I can port the priority date to the new employer, only after completion of 180 days filing I-485 with the current employer?

2) Can new employer be able to sponsor H1B based on my approved LC & I-140 (from previous employer).

3) What is the worst case switching the employer at this stage of GC process?

Any suggestions/thoughts are appreciated.

I think, you have to start the GC process from the begining. With the co-operation of the current enployer(I-140 approval notice), you can preserve the PD.

Anything other than above would lead to the worst case scenario - loosing the PD.

By the way, if you change job, then you should seek options for changing your category to EB2.
