Hello everyone,
I need some advice on my H1B visa.
My OPT got expired by end of May 2005.
My H1B started in March 2005. My employer cancelled my H1B by end of June 2005 and did not inform me about that till i found out by end of august 2005.
During the period i was on H1B, i did not work as i didnt have any projects. So, i dont have paystubs for that period. He didnt give me my copy of H1B papers either.
The case status online and the customer service ppl at INS said that my first H1B is still approved even few days back. Is it that they have not updated their database?
After the misunderstanding between me and the employer was cleared up, he applied for a transfer at his friends company by the end of September 2005. Let me remind you, he didnt give me any papers yet accept for the receipt number from the first H1B.
I have been working for the second firm after the receipt number came.
Now, a query has come for the 2nd H1B regarding the recent paystubs of the 1st employment coz i wasnt working and the H1B was terminated at that time.
I dont really know what to do regarding the query and my employer suggests that i go back to India for consular processing. The consulate in India would outright reject my case for the paystub thing and the overstay stuff would come up ?
I have got an offer from another employer now who is willing to do my H1B. I was wondering that if i can provide the paystubs of my current employment for filing for this transfer under premium processing at a new service center, would that help me out of this situation.
Time is running out for me, it would be very helpful if you guys have any suggestions.
