H1B transfer, travel to India

Hi All,

I had a question with regards to H1-transfer and travel to India.

My H1-B stamp is from my current company (A) and is valid until March 2006. I still have a year left on my H1 ie. until April 2007.

I am taking up a new job in the next few weeks with company B.

I wanted to know if I can make a 2-3 week trip to India after I quit 'A' and before I join 'B'.

Is this doable on Company A's visa stamp? Any risks that you might be aware of or suggestions welcome.

Generally its not advisable to leave country while you are in transition stage (transfer from A to B). I am not sure about the implications but one of the friends, who was in similar situation, was advised to avoid travelling outside US by an attorney.

why don't you apply for premium processing and travel after h1 transfer is approved. keep in mind, you DON'T need to get new stamp in passport having existing stamp valid while you return to US. Eventhough your H1 is transferred to company B and PROVIDED that company A HASN'T CANCELLED your previoius h1, you can come back to US without any issues.
