H1B Transfer - Situation

Hi all,

I have a H1B approval (started on Oct 1st) from company A and I have scheduled an interview appointment date at Mumbai Consulate in December.

Company B is ready to do my H1B transfer and I will have to join company B before I leave USA for my stamping of H1B acquired from company A.

If I get an approved visa tranfer from company B, will I still be able to go for stamping in Dec. for company A as I think I am late to cancel my appointment now? OR I have to cancel my trip and the scheduled appointment date and do it all over again for the new company?

Will the Consulate office bother if I get a visa stamped for company A although I start working for company B? Its lil complicated and a unique situation I guess!

You cannot do a transfer even before you land in the US.
So the best thing to do is get H1-B stamping done using Company A I-797 and when you come here in the US work for them till you get 3 paystubs then apply for transfer to Company B.

Thanks for your reply......I am already in USA and working for Company A since Feb-2004......my H1 for company A was approved and effective from 1st Oct. So I have all the pay stubs since Feb-04. I am visiting India in dec for Stamping Only. Hope this explains situation better!

How did you work without H1B approval? What is the visa status of yours untill Oct 1st? It is illegal, if you show the paystub, that you worked without work permit.

Consult with some lawyers.
 
I was working on my CPT so my status changed from F1 to H1B on Oct 1. Is that allright.....u think? Thanks.
