A friend of mine is on H1B with a software consultancy. He was on the bench without pay for a few months at the end of last year and beginning of this year, but is now being paid and receiving paystubs. Once he has his three paystubs, can he then apply for a transfer? The YTD amount on his paystubs is of course lower than it should be after 4 months this year, due to the bench period.
Please note: I am not looking for the standard answer "On H1B he needs to get paid all the time. File a WH4" that certain members may post.
What I am looking for is real experiences. People who have attempted this. Were you approved? Rejected? RFE?
