I have some questions regarding H1B Transfer. I would appreciated your help in answering my questions.
While I am on F1 (Student Visa) OPT, company A applied for my H1 in December and put the start date as July 1st as my OPT expires in July 15th and I got the H1 visa in March. I started working on a contract job for the company A from February on OPT. But my project with the client ended on June 30th and I am on bench. I got another contract job through company B. Now I want to join the company B and transfer my H1 to company B. When can I start working for the company B? Is it as soon as I dispatch the H1 transfer documents to INS( USCIS) or until I get the receipt from the INS. I dont want to inform my old epmloyer company A in advance as they might cancel my current H1. So when is the best time to inform my old company (company A)? Can I inform after company B sent the documents to the INS or should I wait until I get the receipt from the INS? Can company A can file any law suits or actions against me? I haven't worked for company A since my H1 started (July 1st). I am sending the pay stubs that I worked with OPT for the months May and June for the H1 transfer. In my passport I still have a F1 visa. Is it a problem in getting the H1 transfered.
