I have a doctorate degree from a reputed US institution. I have been working for another University since 2002 as a faculty. Now I wish to transfer to a private organization. Can I transfer my H1 according to AC21?
I obtained the following from USCIS page:
"AC21 also specifies that an H-1B worker be counted against the cap if the worker transfers from an "exempt" employer to an employer that does not have an exemption."
If I can do that, does that mean I can start working right away following the "portability" provision? If this does not count towards the cap can I come under 2005 and start working right away Or does my new H1 allow me to start working on October 1, 2006? I am afraid my new employer might not be willing to wait 6 months.
