I got laid-off about 5 weeks ago and my last working day with my ex-employer was March 31, 2009. Luckily, I got a job offer, joined a consulting company and started working for their client. The consulting company applied for my H1B transfer on February 23, 2009, however, it got denied on April 30, 2009. I plan to make an appeal as soon as I receive the reason for denial by mail.
My questions are:
1. Am I out of status now? Can I continue to work for my current employer on the H1B issues by my ex-employer which is valid until March 2011?
2. How long does the USCIS take before updating the information in their system? The lawyer at my previous employer had told me that they will notify USCIS of my job termination after a month from my lay-off date.
3. While I make an appeal and await USCIS's decision, can I transfer my H1B to another consulting company? Can I send another H1B transfer request to USCIS while the previous H1B transfer is in the appeal process?
