H1B transfer confidentiality: can your former employer find out who your new employer is

Hi All,

I am currently working for company A under H1B and recently got a job offer from company B.

Within the frame of the H1B transfer from company A to company B, is there a way for company A to find out about who my new employer is?

Any insights would be very much appreciated.

Thank you!

Thanks Concerned4us.

There is indeed a non-compete agreement. I was exploring the different possibilities considering that NY law favors employees in such cases.

I am probably going to talk to my manager once the transfer has been successful as the firm has been lenient on enforcing this policy.

I would tread very lightly here if I were you... The last thing you need is for your status to be jeopardized over legal issues stemming from violating the non-compete clause your company probably had you sign. I would be sure to talk to your manager BEFORE the transfer is complete, rather than risk a major headache after the fact.
