H1B Transfer but Passport Expired

Hello,

My current H1B visa expired 08/2007 and I already have the visa in my passport. I already have a labor certification and I-140 approved. I have an exciting job offer so I decided to accept it. The new employer will transfer my H1B visa but I just found out that my passport has expired for 5 months. Would that cause a problem to INS because I have an expired passport? The new company will start the transfer paperwork in a week and renewing the passport will take weeks...

Would that cause a problem to INS because I have an expired passport?
 
Why don’t you renew your passport first? Isn't it true a passport should be valid at least 6 months before one can seek the immigration benefits?
