My employment was terminated by my company without giving notice on May 26th but the company paid me salary till 2 weeks after that because they did not give me notice.
I did not get a termination letter but I got a letter saying that me and the company mutually agreed to seperate if I sign the document I will get 7 weeks of severence and will be covered under the company's insurance for 7 weeks. I have a 45 day window to sign the document.
I contacted the company's lawyer about what happens to my h1b and he says nothing but to start looking for a job as soon as possible and get a h1b transfer soon.
My questions are.
(1) What is the window I have at this stage for a h1b transfer?
(2) If the company revoked my h1b already without me signing the seperation statement as yet, will I be eligible for a h1b transfer?
(3) Why is the lawyer telling me to start looking for jobs rather than tell me my employment is terminated and h1b is revoked and I cannot do h1b transfer?
(4) If at all I use my 45 day window for signing the mutual agreement that me and my company decided to seperate mutually and get my severence, does it not mean that the company must have me on rolls till then and only then revoke my h1b?
I am a bit confused here because this layoff is unusal because there is no solid reason and I have been told by HR on phone that I am terminated for some reason but the seperation statement that I need to sign says that me and my company mutually agreed to seperate which I have not yet signed.
Does not signin the document allow the company to revoke my h1b visa?
Lawyer only says look for new job soon. Does it mean that they have not really revoked my h1b visa?
