I am in the US on an L1B visa, valid till Apr 2009. My spouse is on an H1B, which expired in July and is in the process of being renewed for another 3 years.
The problem is this - He wants to transfer his H1 to another company B, but company A(the present one) has already filed for his extension. The extension seems to be taking forever(the receipt of notice hasn't arrived).
If company A, for some reason, does not give him a copy of receipt of notice, company B will not be able to transfer the H1 in time.
My questions are -
1) Is it possible for him to ask company B to file for his L2? If his L2 approval comes quickly(by requesting premium processing) and his H1 extension is still in process, can he start working on L2 and ask for H1 extension to be cancelled?
2) Will he have to go back to our home country for the L2 to be stamped before he can start working?
