I am on H1B and my current I-94 is valid till Sep-2009 with Company 'A' (consulting company) . I have applied for a H1B transfer with Company 'B' (end client) and awaiting my approval. My wife is also on H1B and her I-94 is also valid till Sep-2009 with Company 'A' (consulting company). But her project is over and she is looking for a new project. If she does not get a project by July-2009, she will probably not get approval for the extension, so we are planning to go with H4 visa for her now. I have the following options in mind, and would like to know which is the best option
1) Apply for change of status from H1 to H4, and stay in the US. If we consider this option
a) how much time will it take for the change of status
b) will she have to maintain her H1 status until her H4 is approved
2) Go to native country by end of July and apply for fresh H-4 stamped.
If the employer cancels her H1, how long can she stay in US after the H1 is canceled/revoked?
