I have recently been admitted to a top US Business school. I am currently
on an H1B and my employer plans on sponsorning me to school (paying for my
tuition) and I will return to same employer at higher level after school.
I have applied for a Green Card and my brother submitted a I-130 for me 4 years ago, therefore I am likely to have an F1 rejected due to immigraton intent.
Is this true that my F1 is likely to be rejected?
Can I study on my H1B even though I will not be working (i.e does the 'employer/employee' relationship still exist)?
Will I need to file for 'leave of absence' on my H1B through my employer for 2 years? Is that possible without leaving the country?
