H1B to F1 Transfer, I-140 filed

Hello All,

Pardon me if this has been covered before. I am in the following status:

1- I recently received my 8th year H1B Extension valid till April 2009.

2- My GC was filed in January 2004 in EB3.

3- Labor approved October 2007.

4- I-140 filed November 2007. Haven't heard anything since.

I always wanted to do my MBA (already have MS from US, used up OPT). I don't know how much longer my GC will take, specially with retrogression. It may be another 4 years before I get my GC.

My questions are:

1- If I-140 has been filed, can I convert to F1 to go school.

2- What are my visa options for going to school fulltime.

3- Is there anyway I can continue my GC process and still go to school.

4- Any clause by which my employer keeps me on roster, while I am in school. Some sort of sabatical, my employer will not sponsor my MBA.

5- My wife is also on H1B, can I go on H4 after I-140 has been filed.

6- Can I go to school on my wife's H4.

Filing F-1 at this stage is risky - as F-1 does not permit immigrant intent. You can move to H-4 provided the GC application is based on your wife's H-1B. Apparently I ran out of ideas ... can someone else add here?
