H1B to F1 and back to H1B

Hi,

I have a quick question and need help from the wonderful readers of IP forums.

I originally came to US on a F1 visa and completed a four year degree, after which I worked here in H1-B for five years. I am going to Business school this fall and have appx. 14 months left on my visa.

My question was if after graduation, If I find a job, would my visa be valid for 14 months only? My last employer never really filed for my LCA/PERM, and I am hoping my new employer should do that. In case they don;t what are my other alternatives besides leaving the country for a year to reset the H1-B time period.

At this time you must leave for a full year and go through the quota for another 6 year term.

Unless and until the employment situation in the US improves, it is unlikely that another degree will improve the chances of having a PERM approved since every USC and LPR obtaining your degree will also be qualified for the job based on the higher level degree.

You should not base your plans on the expectation of GC processing within your remaining time in this 6 year term to qualify for the extensions.
