H1B to EAD ??

Hi!

I joined a company A in october and they did a H1 transfer for me. Started working for them after I got the receipt. Later on I filed my GC and got EAD also.

Now USCIS has issued a RFE on H1. If they reject the H1 transfer for any reason, can I use the EAD to work for company A even though I got EAD in March and I started working for company A on the basis of H1 B receipt notice ?

What is the worst that can happen with this case ?

Yes you can. If you are using AC-21 - just count 180 days are over for you to change the job. But wait for UCCIS verdict on response on RFE.

AC21 will apply if I change jobs using EAD. However I intend to work for the same company just that due to H1-B rejection ( assumption) I am going to work for them on a EAD.

How will USCIS look at the time from October to now when I was working on a H1B receipt and that H1-B is rejected now?

You joined A in October and got LC/EAD so fast? Which October and which place are you located? Did A apply for your GC?

Don't worry INS cannot do anything about period of Oct till now - you were in status.

Thanks for the assurance. Yes company A applied for GC with a substitute labor in December and I got my EAD last month.
