H1B Stamping

Hi,

My wife came to US on H4 visa and she got her H1B approved. At present she has her I-797, but no H1B stamping in her passport and she is working in US.

Is it possible to get the stamping done in Canada or Mexico? Or is there any rules/restrictions that first H1B stamping has to be done in the home country (India)?

I had similar situation with my wife. Canada consulate WILL NOT stamp if one has come to USA on H4 or L2 and converted to H1. They check whether the applicant's Educational/Experience qualifications were already verified in their Home Country or not.

In your case, your wife can get H1 stamping if she, at any time, came to USA on any work VISA (like L1 etc..).
Otherwise, it is strongly recommended to go to home country for stamping.
 
Hi friend,

1) I came to US on June 2005 on L2 Visa.
2) Applied for H1 in April 2006 and got it approved on Oct 2006.
3) Joined a company and am working there since Oct 2006.
4) Now myself and my husband have to go to India in January end and planning to come back to US on Feb end.

My problem is that I am confused whether its a right decision or not to go to India at this time,as I may face problems during H1 stamping in New Delhi.
I do have 3 months of Paystubs and will get my W2 also.I have 1 year of prior experince in India and my education is MCA from India.

Can you help me by sharing their knowledge or experience and suggest how much risk is involved if I plan to go for H1 stamping in January end.
