H1B Stamping question

Hi,

I will be going to Canada for h1 stamping (first time), i have transfered my h1b from 1st employer to 2nd. I have Original I-797A for 2nd employer but have only a copy of I-797C for 1st employer. Also I have I-94 from 1st employer. Please let me know if the I-797C copy will be ok for 1st employer.
Also, i will complete just over 2 months with the 2nd employer at the time of visa interview.

I'm in the same boat as you are First Time H1b stamping, also I have a Non-us Degree too.

Have you got your stamping ? since you posting date is in April.

did u get ur stamping done in Canada.. I am also in somewhat similar situation. i do not have a Us degree.. Can u tell me if you got ur stamping done in canada

I had similar situation when I went to stamping in Mumbai in 2004 as well as July 2006. They never asked previous employer's I-797. Usually they do not. However, legally my present company lawyer advised me that we should do 2 things 1. Send email as well as a postal letter with acknowledgement to first employer 2. Once you do not hear back, from them or they deny to give it somehow - take print out of the email / letter - you can request INS for the duplicate I-797 copy. If you have sufficient time, you can still do it. Otherwise don't worry too much. I am sure Mumbai/Montreal consulate doesn't ask for it. Not sure about rest of canadian consulate. But you can atleast take a printout of email you sent to 1st employer for proof that you asked for it and they never replied.

Not having US degree is a matter of your personal choice. If you have IT degree and working in IT field, I believe you should not have problem. Mostly people who are sent back to home country, never wrote about their degree and work field being different on this forum. so it is difficult to justify what I believe is right or wrong.
