H1B stamping in chennai

Hello,

My H1B VISA expired more thana year ago and my new H1B approved is valid till Jan 2004 . Can I go to India in OCTOBER and get my VISA stamped even though it is good only for 3 months or is it really risky to go to india at this time ?

If you had less than 1 year after h1 visa expiration you could have got a visa at Dept of state in the US. Now since you have crossed 1 year, you may not be eligible for drop box in India.
if you are planning to travel to India anyway, you should get an appointment for visa ASAP.
 
Thanks for your reply! I do have an appointment for the 9th of Oct. I am concerned that I only have 3 more months on my visa and will they stamp it on my passport or do they require a visa that is valid for atleast the next 6 mths?
I have completed 4 years and need to get an extension for the next two years. My company is willing to do an extension for me but it will take a few months to get that and I need to go to India in Oct. So is this risky or will they stamp it for 3mts?
I can get a letter from my company that they are willing to do my extension if required.

Hi scram,

I applied at Chennai for my h-1 back in 1999 when i had only 5 months left on my h-1 and i got it approved without any issues. i was worried about it being less than 6 months- but it worked but I guess it was pre-Sep 11th- so I really cant advise you one way or another.
