Asking the below on behalf of a colleague..
He currently have an H1B petition approved with the current employer till 2013 end (with I-94 issued). About 2.5 years back an H1 transfer for him was denied from Employer A to B, he had already started working for employer B on portability and worked for him for 4 months till transfer was denied. He found another employer C and started working for them exactly after one month. Now he want to visit India and have to go for stamping as current visa stamp has expired. He wanted to know if its OK to show this one month of gap in employment in visa interview form DS-160, how could that adversely affect his chances for getting visa stamped.
Note: Employer B paid him a severance pay for 1 month (Taxes paid) and filed an MTR within one months time which was also approved and visa granted with I-94. Although He never worked for B again.
