My company filed my H-1B through premium processing. I received an RFE on June 13th 2006 and it is as follows:
The evidence submitted does not establish that the job offered requires the services of a person performing a " specialty occupation," i.e., the holder of at least a baccalaureate degree in a related field. Please submit evidence showing that in your company or industry, a baccalaureate degree in a specific field of study is a standard minimum requirement for the job offered."
How many other individuals do you employ in similar positions? Of these, how many hold at least a baccalaureate degree? In what filed of study?
" Submit additional evidence that the position of Computer Systems Analyst qualifies as a " specialty occupation," that is, evidence that the job requires services of the holder of at least a baccalaureate degree. This should include a detailed statement setting forth the beneficiary's proposed duties and responsibilities. Also indicate the educational requirements of the proposed position and how the beneficiary's education relates to the position itself.
The beneficiary appears to be qualified for a speciality occupation in the field of Mechanical Engineering. It is not evident from the documentation provided that the beneficiary is qualified for any other speciality occupation.
Please submit additional evidence that clearly shows the beneficiary qualifies for a "specialty occupation." Evidence must show how the beneficiary's degrees in Mechanical Engineering qualifies him for the proffered position as a Computer Systems Analyst. If the degrees are not in a directly related field submit a statement detailing how the degree relates.
Coming to myself, i have completed my B.E in Mechanical Engineering and my M.S in Engineering (Concentration: Mechanical). But i had a 1yr of work experience as Software Programmer before doing my Masters. Also i have undergone training in some of the software courses also during my undergraduation based on which i got that software job. Even though my company has submitted all those papers, still i have this RFE. For this, my Company said that they will first evaluate my credentials from Morning Evaluations which will say something like all my skills are equivalent to a Baccalaureate degree in Computer Systems. Will that be sufficient for an RFE like this?So, could somebody give me an idea of how they have responded to an RFE like this? I am sorry for writing such a long story, but i just want to give you guys an idea what the problem is completely so that it would be easy to answer it....
