H1B Revalidation

Can somebody help me to clarify few question about H1B revalidation. I have gone through entire forum but couldn't get info what I am looking for.


1. Do I need to get visa stamping on my passport (revalidation) as my. current stamping is going to expire on Sep30 2008. I have new approved I-797 from my new employer with new extended date as Feb2010. I have new I94 which came with new I797. My current I94 (issued when I entered US 2nd time on old visa stamp from my previous employer) is valid till Sept 2009(as I was having another extended I797 valid till 2009 at that time) .

I have already taken interview date at Maxico US Consulate in Baja CA. But just want to make sure that I have to really get revalidation. I am planning to go to India in Nov-Dec 08. I know while entering back in US I need a valid visa. I don't want to take chances of getting stamping in India as I will be not able to enter back without visa at that time and will get stuck up. I want to make sure I get it now to be on safer side.

Or is it better to get revalidation in India using dropbox facility? Am I eligible for that during Dec08 with expired visa?

Does valid I94 and new I797 will be sufficient or I also need valid visa stamp on my passport while entering back in US in Dec08.

You input will be helpful.

If you re-enter before September 30, 2008 then you don't need a visa stamping. You can get the new visa stamped before that date in Mexico, please carry all non-US educational evaluations. However, in case the application is rejected (hypothetical scenario), you cannot re-enter the US directly.

Why do you think you have less chance in your home country? You can get the visa stamping while in India too ...

By the way I-94 document is of no consequence for re-entry. You have to surrender the latest I-94 during exit.

Thanks for your response. So you are saying if my Visa is rejected I will be NOT able to enter US (on 27 Aug 08) even if I have old visa left till Sept30 2008. Are you are sure about that ? If this is the case then I will be in sticky situation. what are the option left to me in that case. do you think its better to get Stamping in India ? Please advice. I am confused now ?

Oops I overlooked the fact that you will have a valid visa while applying for revalidation. However, even that does not makes you risk free. All depends upon the consulate whether they will cancel the existing visa (of similar category) or not.

I believe, consulate will 'cancel the visa with out prejudies' once you attend consulate, regardless of the issuance of new visa.
