Guys,

My last H1B visa expired sometime in December 2002. I have a H1B extension approval notice. I want to re-validate my H1b... so wanted to ask if I can do that now? Because the website says, it has to be expired less than 1 year... now is this the date by which they receive the application or by the time its approved? Because if I send the application now, it is within the one year expiry limit. But given than they need 3 months to approve, by the time it is approved, it will be more than one year after expiry...

Please advise... I have to send the application as soon as possible.

Thanks!
SK...

As soon as your application reaches there before you complete your one year for expired visa, you are ok.

Yes, like PremChopra said, your appln has to reach them before 1 year period. I have sent my appln in Sep and my one year period gets over in October. As you know, they will approve it only in December.
