H1B Revalidation in Ottawa

Hello Everybody,

Here is my case.

1.Entered U.S on October 2000 on H1B Visa. Visa valid from May 2000 to May 2003.

2.Got Laid off from the company A February 2002 and my company offered me to change my status from H1B to B1 to find another job. Because my company A felt that should inform INS that they let go of me. I accepted that offer and I went to B1 from H1B. So my status was B1 from February 2002 to August 2002.

3.Found a new job with company B on may 2002 and got new H1B valid from May 2002 to May 2005.

4.Sent my passport to St.louis for Visa revalidation for my H1B with the company B. Got stamping and traveled to India and came back with no issues.

5.Applied for H1B extension with Company B and I will get H1B for my remaining period which is 1year+ 4months because I was in B1 for 4 moths.

6.Now I have a valid H1B visa, which is expired on May 2005 and got my extension from May 2005 to Jan 2007.

7.I have an appointment in Ottawa for H1B extension on March 2005.

Since I have valid H1B visa in my passport and I am going for the extension with the same employer I guess I should be fine. And I have already talked to my lawyer and he said I will not have any issues at all.

Gurus, do you guys think it will be a piece of cake or i might get into trouble since i went to B1 and came back to H1B. FYI, I have all the documents with me and i never been out of status.

My company filed my labor and still it’s pending. What should i tell the officer if he ask me whether my employer filed my G.C or not?

Do you guys think the office will think my case is kind of fishy since mine is not a 3 years extension or 7 th year extension. Actually mine is 5th year extension.

Your replies are highly appreciated since i have to make up mind with in 2 weeks to go for it or stay here in U.S forever/until i get my G.C.

Here are some answers to your questions (in my opinion):

A: I think it's good that you 've never been out of status and have obeyed all immigration laws. As long as you have a paper trail to show the visa officer - there should be no trouble.

A: Labor is not equivalent to GC. Your answer can truthfully be 'No'. H1B status allows you to immigrate and also come into the country with the intention to do so, so saying 'Yes' is not a problem either.

A: If you have a paper trail that you've been in status, then nothing is 'fishy'. You're a tax payer!!

The bottom line is, that if you have paperwork to prove that you are in status and have always been in status and are getting paid by your employer, you will have no trouble. Just arrange all your documents properly and produce them when asked. You'll make it with no trouble.
