Situation:----
I have applied for I140 under EB1 ("Outstanding Researcher Category) on September 10th, 2003. It has been over six months. However, my I140 is still pending at Texas Center. My present status is H1B (started on May 2002). I will have to renew my H1B on Jan 2005. My wife's H4 will also have to be renewed on April 2005.
I am also thinking of applying for I485 and EAD for my wife (who is presently in H4).
Questions: ----
(*) Can I file for I485 (adjustment of status) and EAD (authorization for my wife to work) for for my wife FIRST, and then renew my H1B?. I do not want to apply for Advance Payroll as I want to use my H1B status.
(*) Can I file for I485 (adjustment of status) and EAD (authorization for my wife to work) for for my wife FIRST, and then renew my wife's H4?
