H1B renewal - 240 day rule

Hi,

My H1B visa expired on January 1 2005. My attorney has already filed for a premium processing extension and the USCIS website says that they have recieved the application on dec 27th 2004. Since my lawyer already has the certified labor condiction application, do I automatically get a 240 day extension on my visa or would I be considered out of status till my visa renewal application gets approved.
Also my drivers license has expired (I live in florida) and the drivers license office told me that I cannot get it renewed till they see the documents approving the extension of my H1-B.
Kindly advice.

You are in status since you applied for your H-1 before your H-1 expired. Do not worry. Now a days the DMV is looking for valid H-1.
