Hello All !!
Please do tell me what might be the best choice for me.
I got my First H1 from a university "A" in texas with a valid I-94 . In August 2004, I stopped working for University "A" and transferred this h1 to another university "B" .
In the mean time i did apply for another H1B from a consulting company "C" and my h1 was approved with a valid I-94.
In the mean while Now University "B" didn't file my paper work as the HR director didn't know the right process. I did get paycheks from University "B". I kept on asking the hr department and they told "You do not have to worry as everything is taken care of ". Total ****.. Bull **** @@#*(@#*@()*#)@(*#@)(*#)@(*#@.
She never filed those papers and when i asked for the receipt again and threatened them saying i would leave this job if i dont see the receipt . They filed my papers in December last week saying department of labor has given wrong information and the original papers were lost in INS Nebraska SC.She never applied for my h1b .
In march NSC issued RFE asking for my Paystubs from my previous employer and LCA. she did not even submit the LCA first time. My last paycheck from University "A" was in August 2004 and we submitted.
My H1B was approved without I -94 and was asked to attend at Mumbai for a Visa . They did mention about the 3 months and 27 days being out of status.
Now University "B" says I have to leave the country and get a valid I-94 and sort this matter out. (so easy to say.... )
I couldn't find an appointment until october 20th and they say that I can't get paid until october 20th.
I am trying for an emergency appointment at mumbai as my current job really needs me and can't afford to keep this job vacant as we have a major accreditation process going on for one of our department and the deadline being Dec'2005. It was me and me who was working on this major project and nobody can take over it as of now. UNiversity "B" did fax and email the embassy in mumbai for an emergency appoinment.
Can some please please answer this ?
A) can i sue University "B" ( i do have paycheks given to me from september to December 2004 ) ?
B)Can i start working on Company "C" H1 as i have a valid I -94 until 2007.
C)University "A" never revoked my H1b. I still have valid I -94.
d) keep quiet and wait until i attend visa from Mumbai.
