H1B problem

Dear Joe,
My name is venkat. Now I am in India, working as a software professional in satyam computer services.
I did my Masters in Computer Engineering in the University of Memphis, Memphis, TN, USA in August 2002.
In the final semester of my masters, I used to work in gold shop and was caught by INS. INS cancelled my visa and told me to go back to India with in 4 months. INS Court has ordered me to pay $ 2000 as bond money. This
bond money will be returned only when I will be in India with in that 4 months specified time. My lawyer also told me that I can come back to US with new H1 visa because of F1 is cancelled.

I came back to India with in 4 months and I got the bond money also. Now, I applied for H1B and got approved. I got the H1B visa through interview(Bombay) recently. I want to come back to US on H1B.

My question is, Will there be any problem while I enter to US in the port of entry? Or During my stay?
If so what kind of problems I have to face?
Will I get any problems from credit card companies?( I have debt
of around $10, 000).
Will the credit card companies can do anything legally?
Please suggest me the precautions I have to take during my stay. Your suggestions are more than orders for me.

Thanks in advance,
Venkat.

It sounds like you accepted Voluntary Departure prior to the Merits hearing (120 days can be granted if VD is accepted prior to the Merit's Hearing, at the Merit's Hearing, the Immigration Judge is limited to 60 days VD). Since you appeared for the hearings and left prior to expiration of the VD period, you did not trigger any bars that way.

Since your H-1 was granted by the Service and issued by the consulate, you should be able to reenter at this point.

As far as your debt is concerned, the credit card companies may have written it off as bad debt by this time. If not, depending on the facts and the applicable Statute of Limitations for an action based in contract, they may be able to bring suit in state court to recover the upaid debt. Your credit card debt has nothing to due with your ability to reenter the US (as long as there was no fraud involved) but the companies may be able to come after you for the unpaid amounts due, probably plus interest and attorney fees.
