I have some questions on the PENDING H4 TO H1B Change of Status
application with USCIS. Currently
the beneficiary is on a valid H4 status in US. Based on it I have the
following questions, could you please answer it:
If the company WITHDRAWS the H4 to H1B change of status
application (before the application is approved)
and if the withdrawal is SUCCESSFULLY acknowledged by
USCIS.
a) What STATUS would the beneficiary be after the WITHDRAWAL OF H4
to H1B change of status application has been
acknowledged and SUCCESSFULLY performed by USCIS?
(Currently the beneficiary is in a valid H4 status in US).
b)If the beneficiary WILLN’T be in H4 STATUS after the SUCCESSFUL
WITHDRAWAL of the H4 to H1B change of status
application , what IMMIGRATION action has to be taken
to BRING the beneficiary TO H4?
c) If the beneficiary STILL REMAINS in the H4 STATUS after the
SUCCESSFUL WITHDRAWAL of the H4 to H1B change of
status application, will any further IMMIGRATION
ACTION have to be taken to CONTINUE the beneficiary in the H4
STATUS?
